Fusion Advantage FAST Privacy Policy

The FAST Privacy Policy describes how your personal information is collected, used, and shared when you use a Fusion Advantage Site Tool ("FAST").

1. DEFINITIONS

"Fusion Advantage," "we," "our," or "us," means Tess II OpCo, LLC d/b/a Fusion Advantage, a Delaware limited liability company, our employees, officers, directors, parent, affiliates and subsidiaries.

"FAST" means Fusion Advantage's Websites, Apps, and Services collectively.

"You" or "your" means the person or entity that is registered with us to use FAST.

"Websites," means our websites located at Fusion-Advantage.com, including all subdomains and sites associated with those domains, and other websites that we operate now and in the future.

2. NOTICE TO END USERS

If you use FAST with an account provided by your workplace or other organization, Fusion Advantage can:

  • control and administer your account, including privacy-related settings; and
  • access and process your data.

Your use of FAST is subject to Fusion Advantage's policies. You should direct your privacy inquiries, including any requests to exercise your data protection rights, to privacy@fusion-advantage.com.

Fusion Advantage is not responsible for the privacy or security practices of our customers, which may differ from those set forth in this privacy statement.

3. WHAT WE COLLECT

  • Information you provide to us: When you register for and use FAST, you are providing us with information, which we collect. This information may include your name, email address, phone number, emergency contact information, and similar details.
  • Information from your use of FAST: This information may include IP address, location information, date and time, browser type, and any other action you might have taken to use and while using FAST.
  • Cookies: When you use Fusion Advantage's websites, we store "cookies," which are strings of code, on your computer. We use those cookies to collect information about when you visit our Website, when you use the Services, your browser, your operating system, and other similar information. Most browsers allow you to block and delete cookies. However, if you block our cookies, our Services may not work properly.
  • Third-Party Cookies: The use of cookies by third-parties is not covered by our Privacy Policy. We do not have access or control over these cookies. We may use third-party services to provide the necessary hardware, software, networking, storage, and related technology required to run and improve our Services.

4. HOW WE USE YOUR INFORMATION

  • To create your account.
  • To provide customer support.
  • To improve our products and services.
  • To send you updates and alerts.
  • To respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims.

5. HOW WE DISCLOSE YOUR INFORMATION

  • To provide customer support.
  • When we have your permission to share your information, or when we have given you prior notice that the information will be shared.
  • When we are required by law, or legal process to disclose that information, such as a court order or a subpoena.
  • When we believe in our discretion, unless otherwise prohibited by law, that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.
  • To enforce our terms and conditions or to protect our operations or users.
  • If a transfer of your information is required under the terms of a reorganization, merger, or sale of the company.
  • When we determine that information is aggregate information or other information that does not identify you.
  • Pursuant to the California Consumer Privacy Act of 2018 ("CCPA"), we do not "sell" your information (that is, disclose your personal information for monetary or valuable consideration).

6. YOUR CHOICE

You have choices when it comes to the technology you use and the data you share. When we ask you to provide personal data, you can decline. Fusion Advantage requires some personal data to provide you with a service. If you choose not to provide data required to provide you with a product or feature, you cannot use that product or feature.

To unsubscribe from email communications, email unsubscribe@fusion-advantage.com using the email address you wish to no longer receieve email communications from.

To opt out of text messages, reply to any Fusion Advantage text message with the word 'STOP'. This will opt that phone number out of future text communications.

To opt out of phone calls, please call +1 (888) 523-8268 / 888-5-ADVANTAGE and select the option for healthplan members. An agent can record your request to no longer recieve phone communications from Fusion Advantage.

Please note: emails, phone calls, and text messages originating from you to Fusion Advantage agents and clinicans may be responded to regardless of a previous communication preference request. Additionally, Fusion Advantage may reach out to members regarding urgent medical information discovered as a result of a previously rendered service(s), where such information is of a time sensitive nature or has significant or life threatening health consequences.

7. SECURITY

We take administrative and technical precautions to safeguard your personal information against loss, theft, and misuse, as well as against unauthorized access, disclosure, alteration, and destruction. We follow generally accepted industry standards to protect your information, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, however, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

8. CORRECTING & UPDATING INFORMATION

If you are our customer and would like to access or delete information that you provided, you may do this by signing in to Fusion Advantage and making the change or by emailing us at privacy@fusion-advantage.com. We will respond to your request within 30 days. We may decline to process unreasonable requests or requests that are not otherwise required by local law.

We retain your information and data that we process on your behalf as long as your account is active, as needed to provide our Services, and as necessary to comply with our legal obligations and resolve disputes.

We reserve the right to modify this privacy statement at any time, so please review it frequently.
